Terms and Conditions of the Supply ofExpert Witness Information to Carswell

 

Definition:  "CarswellCompanies" means all companiesproviding services under the brands of Carswell, Thomson Reuters Canada Limitedor Thomson Reuters Corporation or Thomson Reuters PLC, and their subsidiaries,and any successor company or companies thereof, as a result of corporatereorganization or restructuring.

 

1. License of YourContent to Carswell Companies:

 

(a)  Byuploading, submitting or reviewing any content, information and materials foryour entry profile ("your Content") to a Carswell Company, you grant (or warrant that the owner of suchrights has expressly granted) to all Carswell Companies and all companiesproviding services under the brands of any Carswell Companies, a perpetual,royalty-free, irrevocable, non-exclusive right and license to use, reproduce,modify, adapt, publish, translate, create derivative works from and distributeall or such part of  your Content as theCarswell Company wishes and/or incorporate all or such part of your Content asthe Carswell Company wishes, in and into any form, medium, or technology nowknown or later developed throughout the universe, including use in any website,print directory and/or other product or medium into which your Content isinserted ("Carswell Product");

 

(b)  Youagree that if a Carswell Company obtains other information relevant to yourstatus or role as an expert witness ("Other Information"), then aCarswell Company may use such Other Information together with such part of yourContent as the Carswell Company wishes in a Carswell Product, provided that ifyou ask that the Other Information be removed from any Carswell Product, thenthe Carswell Company will remove such Other Information from online CarswellProducts, and will remove it from future versions of other Carswell Products.

 

2.  Acknowledgment:  You acknowledge that:

  • the information as submitted in your Content is accurate, complete and current, and

 

  • your Content has been submitted on a voluntary basis, and

·        Carswell’sPrivacy Code, the complete text of which can be accessed at www.carswell.com, containsthe following Exclusions fromprivacy protection:

The Carswell Privacy Code does not impose any limitson the collection, use or disclosure of the following information by a CarswellCompany: a) information that is publicly available, such as a Person's name,address, telephone number and electronic address, when listed in a directory ormade available through directory assistance; b) business-contact information,such as the name, title or business address or telephone number of an employeeof an organization; c) information collected, used or disclosed in the courseof journalistic, literary or artistic activities; or d) aggregate informationthat cannot be associated with a specific person, such as demographicstatistics about Carswell customers, or number of visitors and average timespent on a website.

3. Errors andCorrections. Carswell does not represent or warrant that any CarswellProduct in which your Content is included will be error-free, free of virusesor other harmful components, or that defects will be corrected. Carswell does notwarrant or represent that the information available on or through any CarswellProduct will be correct, accurate, timely, or otherwise reliable. Carswell maymake improvements and/or changes to the features, functionality and content ofany Carswell Product at any time.

 

4. DISCLAIMER.CARSWELL DISCLAIMS ALL RESPONSIBILITY FOR ANY LOSS, INJURY, CLAIM, LIABILITY,OR DAMAGE OF ANY KIND RESULTING FROM, ARISING OUT OF OR ANY WAY RELATED TO ANYERRORS IN OR OMISSIONS FROM THE USE, REPRODUCTION, MODIFICATION, ADAPTATION,PUBLICATION, TRANSLATION AND DISTRIBUTION OF YOUR CONTENT INTO ANY CARSWELLPRODUCT AND/OR FORM, MEDIUM, OR TECHNOLOGY NOW KNOWN OR LATER DEVELOPEDTHROUGHOUT THE UNIVERSE, INCLUDING BUT NOT LIMITED TO TECHNICAL INACCURACIESAND TYPOGRAPHICAL ERRORS.

 

5.  These terms and conditions shall be governedand construed by the laws of the provinceof Ontario and the laws of Canadaapplicable therein.
